Home health patients under Medicare are entitled to the following:

1. Right to Be Informed

  • Be informed, both orally and in writing, of your rights before care begins.
  • Receive information in a language and manner you can understand.
  • Be informed of:
    • The care and treatment to be furnished.
    • Expected outcomes (including potential risks).
    • The disciplines that will provide care.
    • Any changes in the plan of care before they are made.

2. Right to Participate in Care

  • Participate in, plan, and revise your care and treatment.
  • Refuse treatment, and be informed of potential consequences.
  • Be involved in discharge planning and care decisions.

3. Right to Privacy and Security

  • Personal privacy, dignity, and respect at all times.
  • Confidentiality of medical records and communications.
  • Be assured that photographs, recordings, or telecommunication will not be used without written consent.

4. Right to Be Free from Abuse, Neglect, and Exploitation

  • Receive care free from verbal, mental, sexual, and physical abuse, and from misappropriation of property.

5. Right to Voice Grievances

  • Voice complaints about treatment or care that’s (or is not) furnished without discrimination or reprisal.
  • Expect prompt resolution of grievances.
  • Be informed of the agency’s complaint process and contact info for state and federal hotlines (including the State Home Health Hotline).

6. Right to Be Informed of Charges

  • Be informed of all charges related to your care and what is covered by Medicare or other payers.
  • Be notified of any out-of-pocket costs in advance.

7. Right to Choose Providers

  • Select your attending physician and home health agency (subject to availability and coverage rules).

8. Right to Receive Notice of Rights Changes

  • Be informed in writing of any changes in ownership, service area, or ability to provide care.

Patient Responsibilities

To maintain safety, compliance, and continuity of care, patients are responsible for:

  1. Providing Accurate Information
    • Report all health history, medications, allergies, and changes in condition promptly to your clinician.
  2. Following the Plan of Care
    • Follow prescribed care instructions, treatment schedules, and physician orders.
  3. Keeping Appointments
    • Be available for scheduled visits or notify the agency promptly if unable.
  4. Maintaining a Safe Home Environment
    • Ensure the home environment is free from hazards and safe for care delivery.
  5. Respecting Staff and Property
    • Treat agency staff with respect and ensure a safe working environment free from harassment or threats.
  6. Financial Responsibility
    • Provide accurate insurance information and pay for any non-covered services.
  7. Advance Directives
    • Inform the agency of advance directives (living will, medical power of attorney, DNR, etc.).
